Oregon man sues for $43.5M over paralysis caused by brain surgery

A man from La Pine is suing Bend, Oregon’s St. Charles Health System for $43.5 million after complications from brain surgery rendered him incapacitated.

The Bulletin reported that Jackie Dale Yeley filed the lawsuit on Thursday in Deschutes County Circuit Court through attorneys from the Barton Law Group.

The lawsuit alleges medical malpractice and also names Northwest Brain and Spine, a Bend-based surgery provider. The lawsuit was delivered to St. Charles on Friday, according to spokeswoman Lisa Goodman.

She wrote in The Bulletin, “We feel deep compassion for Mr. Yeley and his family as they navigate this situation.” However, we believe that the caregivers at St. Charles provided exceptional care, and we are confident that any fact-finder will concur.
Yeley underwent a neurological procedure on January 8, 2020, at St. Charles Bend, to treat paralysis in his left foot and “vague left leg pain.”

Dr. Kent Yundt and a number of other physicians and nurses performed the operation. According to the lawsuit, Yeley suffered an accidental dural rupture during the procedure, which Yundt recognized and repaired. The brain and spinal cord are surrounded by a robust, fibrous membrane called the dura.
