They’ve been calling since March 2014, they called my boyfriend always naming themselves as Sallie Mae, when he gave them my number, they again said it was Sallie Mae, and it was in regards of my student loan, and that they needed my employer information for garnishing my wages, I said”oh hell no, I will set up arrangements and send a check, money order, cashier check, whatever.” mind you, I still believed it was Sallie Mae representative I was talking to. They told me I couldn’t pay that way at all “at this stage” wtf??? I again asked who the hell it was I was talking to, and she said Tameka from NES, a debt collection agency. I argued about it being in collections because I checked my credit report just days beforehand which was updated on April 30, 2014, and it doesn’t reflect any of my student loans in collections at all. Mind you, my loan is only ten payments behind. It is not a year old. I told her” no, I’m dealing only with Sallie Mae.” Again she told me I couldn’t. Bullshit. I also said my attorney is filing for a temporary deferment” to which she also said that I couldn’t. Bulls*, my attorney informed me that is not true on all counts, They CAN make payments arrangements and take checks, They DO NOT have to garnish my wages, and I can deal with Sallie Mae and I most definitely can file for a deferment. They keep calling and even sunk so low as to spoof my mom’s home phone number and of course I answered for my mom and it wasn’t her!!!! It was this f*g a*hole Paul from NES. .

Misrepresented themselves as Sallie Mae at first,
Misrepresented themselves as Sallie Mae at first, told me my student loans were in collections which is false, unless they have not reported it to credit agencies like TransUnion, as I regularly check my credit report and it doesn’t come up on my report as being in collections. They have called since March my credit report was updated on April 30, 2014 I am 10 payments behind only!!!!. They said the only option for me is to have my paycheck garnished. I said hell no, I’m not giving no goddamn person my employer information or tax information myself that I would pay a payment plan physically by check or money order cashier’s check etc. And they told me I didn’t have that option at all. I again asked who the hell I was speaking to, Tameka from NES, a debt collection agency. I said “no I’m only going to deal with Sallie Mae And that I was looking into getting a deferment for the debt due to circumstances.” They said I couldn’t get a deferment nor speak to Sallie Mae. My tax attorney tells me this is not true, and I’m more than qualified for a deferment, and I absolutely can talk to Sallie Mae. So I told this to NES they are still calling and spoofed my mother’s phone number the other day so I answered. It was that Bryan Howard guy using alias of Paul I saw another post on this website about him. Anyway I and my tax attorney both are now physically writing letters to NES to stop all contact with me as I am only dealing with Sallie Mae.

A few weeks ago, I received a voicemail at work from an Officer Gonzalez from the Maricopa Co. Sheriff’s Dept advising me that he would be serving me a summons at work that day if I didn’t call back a lawyer by the name of Peter Schwartz. I called the number that he left, and it was the NES office. I asked to speak to “Peter Shwartz, ” and the guy who answered advised me that he would handle this for the “attorney” who was busy at the moment. He proceeded to yell at me about how I am a liar because I did not have $800 to give him by the end of the day to pay off a debt that I owe. He said that 99% of people are liars like me. He advised that Fed Ex had been out to my house 3 times to give me documents stating when my court date was. I did some research, and found that there is no Officer Gonzalez at the Maricopa Sheriff’s Dept. I also spoke to people at NES, and discovered that there is no attorney named Peter Shwartz on staff nor can NES bring suit against a debtor. They can only turn unpaid debts over to the original creditor. So, NES impersonated a police officer as well as a lawyer, and they lied to me about notifying me of some fictitious court date. The representative that I complained to at NES said that she would put in a complaint with her manager. She later told me that other people had filed similar complaints, and that the violations were coming from their California office, not their OH office. Who cares which office it is coming from? What kind of sick individuals can impersonate police, lawyers, and god knows who else as well as scream and lie like they did? I can’t think of a more severe violation of the FDCPA. Can you?

First I need to say this collection agency is lower than ###! An employee of NES, using the alias of Mr. Rice, called my 86year old grandfather, who is on SSI, and told him that he was going to file a motion in court tomorrow and sue him if he did not settle out a debt, org 4000.00 for 2800.00 today. My grandfather had no idea what the debt was for and told that to Mr. Rice. Mr. Rice refused to tell my grandfather any more than it was for a credit card. He had my grandfather so intimated and scared that he was shaking and having a hard time breathing. My grandfather paid Mr. Rice, 1500.00 on his visa card and did a check by phone for the rest. He decided it was better to keep his house than to afford his medicine for the next month. I personally called Mr. Rice and told him that he was not going to use scare tactics to force my grandfather into paying for a debt when he counldn’t even tell him what it was for. Mr. Rice told me that if I cared about my grandfather, I shouldn’t mess with his livlihood. He then said that the credit card was FDIC insured, and that when you defraud the govt imprissionment often happens. I asked Mr. Rice if he was going to sue my grandfather, he said YES, if the agreeded upon payments do not clear. I then asked if he was a lawyer, he said no I am a legal assistant. I make 65, 000 less than our lawyers do in this office. I asked if this was a lawfirm he said YES! I asked him if I request by certified mail the proof of this debt, than you must send it to me, right? He said NO! Mr. Rice said that it is now in a lawfirm and the only time I will get proof of the debt is when it is entered into evidence to convict my grandfather of fraud and deceptive practices. I told him that I do not want him to contact my grandfather again until he can supply us with the proof we asked for. He said don’t tell me how to do my job, and you better loose that attitude or your grandfather will be the one that pays. I told him per the FDCPA he has to stop calling if he gets a certified letter from my grandfather. Mr. Rice laughed and said that because he personally works for the creditor, he is not bound to FDCPA guidelines. He then said that Bank of America gave him authorization to sue my grandfather immediately, garnish his SSI check and freeze his bank account. I told him that I wanted to speak to a supervisor, he said that he makes all the final decisions on this case. I hung up. I called back and asked to speak with Compliance, I spoke to a Carol, who wasvery accomodating. I told her my situation, and she appologized on behalf of Mr. Rice. She told me that NES is not a lawfirm but a collection agency and that Mr. Rice is not a legal assistant but a collector. She then credited my grandfather’s visa card and stopped the check by phone payment. She also said that she would be the one handling my grandfather’s file, and that she would order the documentation we requested. She said that if it turns out my grandfather did owe the debt, that she would be more than willing to take 15.00 a month payments, since he is 86 and on SSI. God forbidden, but If my grandfather had a heart attack and died because of the scare tatics this collector used, we could have charged him with involuntary manslaughter, right!

For months now, I have been getting robo calls from NES. When I choose to answer it’s the same thing… they are looking for a person. The person happens to have been an ex-part-time employee. I have no idea where this person is at this time. I go through their robo questions… No, I am not this person, No I can’t go get the person and bring to the phone, No I can’t take a message for this person… and finally, YES.. remove me from the list. Over and over, I have done this because I actually believed they would stop calling… because it was an option provided. I finally called them directly and was in the hold loop from hell. I then found the compliance dept number and finally reached someone. Explained the situation and he said he would remove my number from the robo call list. Very frustrating… and we’ll see if they truly remove it or if I start getting calls again.

Have been getting phone calls from this company for nearly two months now. I get the phone calls nearly every day. I usually don’t pick up but the few times I have, they have been very rude and “over the line.” The number they seem to use the most is [protected]. with different 4-digit extensions for whoever is actually calling. I think the only way to deal with these folks is to not take their calls, and write them the “do not call me unless you’re notifying me of legal action” letter. That’s what I am going to do. Hope this helps someone else out!

I became involved with this company at the beginning of October 2008. My first contact was a very high strung woman named Nina Brown who asked me if I was aware of the pending lawsuit against me for defrauding Chase bank. I had an unpaid credit account with Chase that was closed at the beginning of the year. The debt is legitimate but this was the first I had heard of a collection attempt on the account by a third party collector. These bottom feeders had obviously brought this bad debt. She proceeded to tell me that the lawsuit would proceed and they would garnish my wages and seize any assets I have if I did not pay the 5900 dollar balance on the account with her on he phone NOW. I told her that I did want to have this cleared up, but that I would have to make a couple of phone calls to see if I could get that together. She kept screaming at me and telling me that any hang up would result in her marking the account ‘refusal to pay’. I kept repeating that I was not refusing to pay, but did need to check the status of a few things financially to see if I could pull the money together. She kept saying ‘well we can go ahead and conference call your bank right now so they can give us your information’. She was insistent that I conference call my bank and if I couldn’t then I did not have the money and she would proceed with the lawsuit. I finally told her that I was not willing to do anything like that and we hung up. I was extremely upset after hanging up with her. Within moments I received another phone call from another agent with National Enterprise Systems, Al Johnson. (BTW, I think it is very shady that everyone in this company has very common last names: johnson, Brown, Jones and the like). Mr. Johnson was much calmer and quickly told me that I should ignore what the other agent said and I could settle the account for 3600 dollars. I told him I was not sure I had that and I would have to get off the phone and make some calls to see what I was able to do. He told me that it would be fine and to call him back by Friday to let him know what I wanted to do. I did call him back stating that I was interested in th settlement but would need something in writing first. He said okay and then incessantly called me telling me that he had sent the letter, that should have received it and he needed an answer on what I wanted to do. He badgered me several times about my checking account information saying that they had to have the information to ‘hold my file’. I told him I would get back to him. Well, that was not enough because he began to call every hour on he hour. I was ridiculous! Also, at the beginning of the month he had initially contacted my parents at their house rying to get in touch with me. How he got their number I can only imagine. After this contact, my parents told me they wanted to have nothing to do with it and I told him explicitly not to contact them regarding the matter since I am 26 years old and the responsiblity is mine. Here comes the BIG ONE… After not answering the incessant phone calls for about a week, because I was drafting my debt validation letter to them and had heard NOT to talk to them on the phone, He called my parents again. Mr. Johnson told my parents that I had a debt of 5900 dollars that could be settled right now for 1500 dollars. Mr. Johnson told my mother that I had asked him to call them to take care of the balance, which I NEVER DID! After speaking with my mother and almost getting her credit card number, my father took the phone to try to see what was going on. They told him that the account could be settled right now for an overnighted payment of 3600 dollars. With that my father tore into him and told him outright that he was breaking the law. My father later called back and got the company’s name and address so that he could file a report with the better business bureau in both my state, Georgia, and Ohio. Magically, the incessant phone calls did not occur for a day. This morning I was contacted by a new agent named Mitch who wanted to help me settle my account. Needless to say, I told him to wait for my letter and that I no longer wanted to be contacted by phone and hung up. Of course, he called right back… This company has broken the law numerous times and violated almost every section of the Fair Debt Collection Practices Act (read this if you haven’t already). I am at the point where I want to pursue a lawsuit against them and know that I have a great case based on their actions and total disregard for the law. I would be willing to participate in a class action lawsuit against them as well. This kind of behavior can not be tolerated! WE, as consumers, have a right to not be harassed. This company needs to be brought down and I would love to have a hand in their downfall.

I had a private student loan that i fell behind on. My mother had cosigned on the loan for me so it was expected that they contacted her about my payment. They somehow got my step fathers number and contacted him and gave him personal and private information about me. My parents were seperated and it got ugly. After this phone call it got worse for my mom. They had no legal right to share my information with anyone other than my cosigner.

I have been harassed to many times! I get back to back calls from NES everyday it’s never the same person calling except i have wrote down all the names that call me and Joy is the most frequent. I called and spoke with a Patricia O’Neil, that is supposedly one of the head supervisors. I’ am not even the guy they are looking for and when i tell them that they say “quit lying we know it’s you” and make threats. I don’t see how this company is still in business. I have went to dozens of sites and left similar complaints. I hope your right and together take this company out.

I have had all bad experiences with NES. Since they started calling me early August, we have not been able to come to any agreement. They have threatend and informed me that they had begun legal proceedings. A summons was going to be served on me at my job. They would call HR. One lady who was yelling and screaming, was calling out saying I was in debt (many times) and that I wasn’t responsible enough. She started off her call by saying that she was calling about a fraud I had committed against this debt. I was thrown off as I didn’t know whether someone was committing fraud on my cards… so the story went on only to realise she was using dubious means to get me… It is a nasty company, very dishonest, very bad ways of getting people to pay their debt. Truly I have had my experiences with NES. Well, I called Chase Bank who I owe the debt and asked them for my statement since I could not pull it from online as I was turned over to NES (and I said to the man on the phone, by the way, NES is terrible). I told him that I needed to review my statement as I was no longer sure what was on it.. I also told him that I had filed a complaint against NES with FTC today and sent them a letter of cease and desist communication. The Chase guy explained basically that I was turned over because my card had charged out and that if I faxed them a copy of the letter I sent to NES, they would look at my account again and have me resume making my payments with them… What world are we living in? Is Chase Bank coniving with NES to intimidate people only to turn around if they see that things are not going well and if you mention you have reported the case to FTC? Oh yes we need immediate help…

I paid them $500 over the phone on June 29, 2009 and promised to pay them on the account in July with the stipulation that they call me so I could tell them exactly how much I could afford to pay them. Instead they helped themselves to $1, 500.25 from my checking account without permission. I started a complaint process through my bank and filed an Authority of Revocation. I had no idea that unscrupulous companies who have been paid by phone can go into your account and help themselves. I spent 2 hours with my bank manager, several phone calls to NES as well as to my bank, I was forced to open a new checking account and will probably go overdrawn courtesy of them. I cannot make my mortgage payment tomorrow and have $37 with which to buy gas and live for the next 4 to 6 weeks. They committed fraud and should be shut down.
